These Terms and Conditions ("Terms") govern your access to and use of the NyayMitra mobile application, website, backend APIs, AI legal information features, account features, guest features, incognito features, support channels, and related services (together, the "Service").

By downloading, accessing, creating an account, continuing as guest, asking a question, or otherwise using the Service, you agree to these Terms and to the NyayMitra Privacy Policy. If you do not agree, do not use the Service.

1. Service Provider

The Service is provided under the name "NyayMitra" ("NyayMitra", "we", "us", or "our").

2. What NyayMitra Provides

NyayMitra is an India-focused AI legal information assistant. The Service may allow users to:

Ask legal questions.
Receive AI-generated legal information.
View source links where available.
Ask follow-up questions.
Save chat history.
Use guest mode.
Upgrade a guest account to a registered account.
Use incognito mode.
Select a preferred language.
Copy or share AI responses.
Pin, delete, or clear conversations.
Contact support or send feedback if enabled.

NyayMitra is intended to make legal information easier to understand. It is not a replacement for a qualified advocate, legal aid authority, court, government department, police authority, or other professional.

3. No Legal Advice, No Lawyer-Client Relationship

NyayMitra is not a law firm and does not provide professional legal advice, legal opinions, legal representation, advocacy, drafting services by a lawyer, court filing services, or lawyer-client communication.

Use of the Service does not create:

A lawyer-client relationship.
An advocate-client relationship.
An attorney-client relationship.
A fiduciary relationship.
A professional advisory relationship.
A privileged or confidential legal relationship.

AI-generated responses are for general informational and educational purposes only. They may be inaccurate, incomplete, outdated, unsafe, unsuitable for your facts, or wrong under the law that applies to you.

You are responsible for consulting a qualified advocate or appropriate authority before acting on any information from the Service.

4. High-Risk Legal Matters And Emergencies

Do not rely on NyayMitra for urgent or high-risk matters.

You should immediately contact a qualified advocate, legal aid authority, police, emergency service, court registry, government authority, or other appropriate professional if your issue involves:

Arrest or detention.
Police questioning.
FIR or criminal complaint.
Bail, remand, summons, warrant, or court appearance.
Domestic violence or immediate risk of harm.
Child safety.
Threats, blackmail, extortion, stalking, or harassment.
Cybercrime or financial fraud requiring urgent reporting.
Limitation periods or filing deadlines.
Eviction, demolition, seizure, or attachment.
Medical emergency.
Any situation where delay may cause harm or loss of rights.

The Service is not an emergency response system.

5. Eligibility

You may use the Service only if:

You can legally agree to these Terms.
Your use is lawful in your jurisdiction.
You comply with these Terms.
You are not prohibited from using the Service under applicable law or prior account restrictions.

6. Children, Minors, And Parent/Guardian Responsibility

The Service is not directed to children under 13. Children under 13 must not use the Service, create an account, continue as guest, use incognito mode, submit legal questions, or provide personal information.

In India, a child is a person under 18 years of age for purposes of the Digital Personal Data Protection Act, 2023. Users under 18 may use the Service only with the consent and supervision of a parent or legal guardian.

Parents and guardians are responsible for:

Reviewing these Terms and the Privacy Policy before allowing a minor to use the Service.
Supervising the minor's use.
Ensuring the minor does not submit unnecessary personal or sensitive information.
Ensuring any legal issue involving the minor is handled by a qualified adult, advocate, legal aid authority, or competent authority.

We may suspend, restrict, or delete accounts if we learn that a child or minor used the Service without required consent or in a manner that creates legal, safety, or privacy risk.

7. Account Creation

You may create a registered account by providing required information such as name, email address, password, and preferred language.

You agree that:

Account information you provide must be accurate and current.
You will not create an account using another person's identity or email without authorization.
You will not create accounts for abusive, fraudulent, automated, or unlawful purposes.
You will keep your password and device secure.
You are responsible for activity under your account unless caused by our breach of these Terms or applicable law.

We may reject, suspend, or terminate an account if information is false, misleading, unauthorized, unlawful, abusive, or creates risk.

8. Guest Access

Guest access allows you to use certain features without immediately registering with an email address.

Guest mode may create a backend guest account and save guest chat history. If you later upgrade the guest account to a registered account, guest history may remain attached to the upgraded account.

Guest access may be limited compared with registered access. If you lose the device, app data, or guest token before upgrading, guest history may not be recoverable.

9. Guest Account Upgrade

If you upgrade from guest mode, you may be asked to provide a name, email address, password, and preferred language. The Service may convert your guest account into a registered account so that existing guest conversations remain connected to the same user profile.

You must not upgrade a guest account using someone else's email or identity without authorization.

The app may store an authentication token on your device to keep you signed in and access account features.

You are responsible for:

Keeping your device secure.
Not sharing your password or account access.
Logging out on shared devices.
Telling us if you suspect unauthorized access.

We are not responsible for losses caused by your failure to secure your device, password, email account, or login session, except where required by law.

11. Incognito Mode

Incognito mode is intended to keep a chat out of the normal account history shown in the app.

Incognito mode does not mean:

The chat is legally privileged.
The chat is completely anonymous.
The chat avoids backend processing.
The chat avoids AI provider processing.
The chat is instantly deleted from every server, log, backup, or provider system.

Incognito messages are still transmitted to backend and AI systems to generate responses. Security logs, provider systems, temporary session records, diagnostics, and abuse-prevention systems may process incognito data.

Do not submit confidential, privileged, or highly sensitive information in incognito mode unless you understand these limits.

12. User Content

"User Content" means any content you submit, upload, type, send, share, or provide through the Service, including questions, prompts, chat messages, facts, descriptions, support requests, feedback, bug reports, and any files or text provided through future features.

You are responsible for your User Content.

You confirm that:

You have the rights and authority to submit the User Content.
Your User Content is lawful.
Your User Content does not violate anyone's rights.
Your User Content does not breach confidentiality, court orders, legal privilege, settlement terms, employment obligations, or other duties.
Your User Content does not include unnecessary personal data of children, third parties, victims, witnesses, or opposing parties.

13. License To Process User Content

You retain ownership of your User Content.

You grant NyayMitra a limited, worldwide, non-exclusive, royalty-free license to host, transmit, store, reproduce, process, display, create technical copies of, and use your User Content only as reasonably necessary to:

Provide the Service.
Generate AI responses.
Maintain conversation history.
Provide guest and account features.
Provide support.
Secure and debug the Service.
Prevent abuse or illegal use.
Comply with law.
Enforce these Terms.
Improve safety, quality, and functionality where permitted by law and the Privacy Policy.

This license ends when your User Content is deleted from active systems, except where retention is permitted or required for backups, legal compliance, security, dispute resolution, or de-identified/aggregated data.

14. Sensitive And Confidential Information

You should not submit highly sensitive, confidential, privileged, or unnecessary personal information unless it is necessary for your question and you understand the risks.

Avoid submitting:

Passwords, OTPs, or login credentials.
Aadhaar numbers or other government identifiers.
Bank account, UPI, card, or payment details.
Private images or videos.
Full names of children.
Addresses of victims, witnesses, children, or private persons.
Communications with your lawyer.
Sealed, confidential, or restricted court documents.
Employment secrets or trade secrets.
Medical records unless directly necessary.

If you need confidential legal advice, consult a qualified advocate directly.

15. AI Output

AI output is generated automatically. It may be incorrect, incomplete, outdated, biased, repetitive, unsafe, or unsuitable for your specific facts.

You agree that:

You will independently verify important information.
You will not treat AI output as a final legal opinion.
You will not treat AI output as a court order, government instruction, police instruction, lawyer instruction, or official document.
You will consult a qualified advocate or appropriate authority before taking legal action.
You will not rely on AI output as the sole basis for decisions that may affect legal rights, liberty, property, employment, family, finances, safety, or deadlines.

16. Sources And Third-Party Links

AI responses may include links to legal sources, government websites, news websites, legal information websites, court websites, or other third-party sources.

We do not control third-party websites and do not guarantee:

Source accuracy.
Source completeness.
Source availability.
Source legal authority.
That the cited source is the most relevant authority.
That the source applies to your facts or jurisdiction.

You should independently verify sources before relying on them.

17. Prohibited Uses

You must not use the Service to:

Violate any law, regulation, court order, or third-party right.
Commit, plan, assist, conceal, or justify illegal activity.
Generate fake legal notices, fake court orders, fake police documents, fake evidence, false complaints, forged documents, or misleading legal claims.
Harass, threaten, stalk, defame, blackmail, extort, intimidate, or abuse any person.
Obtain instructions for evading law enforcement, destroying evidence, witness tampering, money laundering, fraud, cybercrime, or violence.
Submit malware, spam, phishing content, credential-harvesting content, or harmful code.
Scrape, overload, reverse engineer, probe, scan, disrupt, or attack the Service.
Use automated systems or bots without permission.
Sell, resell, sublicense, or commercially exploit the Service without permission.
Use the Service to provide professional legal advice unless you are legally authorized and independently verify all output.
Misrepresent AI output as advice from a qualified lawyer or as an official legal decision.
Upload or submit personal data of children or third parties without legal authority.
Circumvent account restrictions, usage limits, or security controls.

We may restrict, suspend, terminate, remove, or report content or accounts that violate these Terms or create legal, safety, privacy, security, or operational risk.

18. Acceptable Legal Use

You may use the Service for general legal information and educational purposes, such as:

Understanding basic legal concepts.
Preparing questions for a lawyer.
Learning about possible next steps.
Finding public legal sources.
Understanding consumer, employment, tenancy, property, cybercrime, or procedural topics at a general level.

You are responsible for deciding whether and how to act after consulting appropriate professionals or authorities.

19. Privacy

The NyayMitra Privacy Policy explains how information is collected, used, shared, stored, and deleted.

The Privacy Policy is available in the app and on the official NyayMitra privacy page.

20. Data Deletion And Account Closure

You may request account deletion or data deletion as described in the Privacy Policy.

Deleting the app from your device does not automatically delete server-side account data or chat history.

If you delete your account, we may retain limited information where necessary for legal compliance, security, abuse prevention, dispute resolution, backup cycles, or enforcement of these Terms.

21. Service Changes

We may update, change, suspend, discontinue, or limit any part of the Service at any time, including:

AI models.
AI prompts.
Search providers.
Backend APIs.
Guest access.
Incognito behavior.
Saved history.
Language options.
Usage limits.
Features and usage limits.
Safety systems.
Support channels.

We are not liable for modification, suspension, or discontinuation of the Service, except where prohibited by law.

22. Third-Party Services

The Service may depend on third-party services, including:

Operating systems.
Cloud hosting.
Databases.
AI model providers.
Search and grounding providers.
Security providers.
Diagnostics providers.
Support providers.
Destination apps selected through your device share sheet.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.

23. Intellectual Property

The Service, including software, app design, UI, backend systems, brand names, logos, prompts, workflows, text, graphics, icons, and other materials, is owned by or licensed to NyayMitra and is protected by intellectual property laws.

These Terms do not transfer ownership of the Service to you.

You may use the Service only for personal, lawful, non-commercial use unless we give written permission for another use.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the Service except where permitted by law.

24. Feedback

If you send suggestions, ideas, bug reports, feature requests, or other feedback, you allow us to use them without restriction or compensation. We are not required to keep feedback confidential or implement it.

25. Suspension And Termination

You may stop using the Service at any time.

We may suspend, restrict, or terminate access if:

You violate these Terms.
Your use creates legal, privacy, security, safety, operational, or reputational risk.
You misuse AI output.
You submit unlawful or harmful content.
We suspect unauthorized access or fraud.
We are required by law, court order, government request, or platform policy.
The Service is discontinued.

After termination, provisions that by nature should survive will survive, including privacy, user content licenses for retained data, intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution, and governing law.

26. Disclaimer Of Warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

We disclaim all warranties, express or implied, including warranties of:

Accuracy.
Completeness.
Reliability.
Availability.
Security.
Non-infringement.
Merchantability.
Fitness for a particular purpose.
Suitability for legal decisions.
Suitability for professional advice.

We do not warrant that:

AI responses will be correct.
Sources will be accurate or available.
The Service will identify all legal issues, deadlines, exceptions, remedies, defences, documents, procedures, or risks.
The Service will satisfy any court, police, lawyer, employer, landlord, consumer forum, regulator, government department, or other authority.
The Service will be uninterrupted, error-free, or secure.

Some jurisdictions do not allow certain disclaimers, so some disclaimers may not apply to you.

27. Limitation Of Liability

To the maximum extent permitted by law, NyayMitra and its operators, developers, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for:

Indirect, incidental, special, consequential, exemplary, or punitive damages.
Legal consequences from reliance on AI output.
Missed deadlines.
Adverse court, police, government, employment, tenancy, family, property, financial, consumer, or legal outcomes.
Loss of data.
Loss of profits.
Loss of opportunity.
Reputational harm.
Emotional distress.
Unauthorized access caused by your device, password, or account insecurity.
Third-party website or service issues.
AI provider outage or error.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of:

The amount you paid to use the Service in the three months before the claim, or
INR 1,000.

Nothing in these Terms limits liability that cannot be limited under applicable law.

28. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NyayMitra and its operators, developers, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

Your use or misuse of the Service.
Your User Content.
Your violation of these Terms.
Your violation of law.
Your violation of third-party rights.
Your submission of unauthorized personal data.
Your reliance on AI output without independent verification.
Your use of the Service to provide professional legal services without proper authorization.

29. Consumer Rights

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer protection laws.

If you are a consumer, you may have mandatory rights under the laws of your country, state, or region. These Terms apply only to the extent permitted by those laws.

30. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, unless mandatory consumer protection laws in your location require otherwise.

31. Dispute Resolution

Before starting a formal claim, you agree to contact us at support.nyaymitra@gmail.com and try to resolve the dispute informally.

Your notice should include:

Your name.
Account email, if any.
A description of the issue.
The remedy you seek.

If the dispute is not resolved informally, disputes will be subject to competent courts in India, unless applicable consumer law gives you the right to bring claims elsewhere.

Nothing prevents either party from seeking urgent injunctive or equitable relief where legally available.

32. Changes To These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide additional notice where required by law.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms, where permitted by law. If you do not agree, stop using the Service.

33. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid or unenforceable part will be interpreted or replaced to best achieve its original purpose to the extent permitted by law.

34. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

35. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a merger, acquisition, restructuring, sale of assets, transfer of service operations, or by operation of law.

36. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms shown in the app for specific features, form the entire agreement between you and NyayMitra regarding the Service.
